(b) at any time when the electricity generation from the facility exceeds the host`s requirements on that date, the host nevertheless pays the supplier to the supplier for all of the electricity generated by the facility, with the exception of Clause 14 (e) of this agreement, at the rates and terms provided by this agreement. At the host`s choice, electricity that goes beyond the host`s needs can be delivered to the local electricity supply company and host receives all payments from the local electricity provider, either directly for electricity or by obtaining credits or payments that could be available by the local electricity supply company under net measurement or similar programs. Where the applicable law or the practice of the local electricity supply company restricts the host`s ability to sell the electricity generated by the facility to the local electricity supply company, the parties agree to other agreements that allow them to obtain payments from the local electricity supplier, provided that the economic benefits to the supplier are maintained in accordance with this section 9(b).

Unless provided in Section 9 (b), the supplier receives all payments available under the ISC and any other federal, national or local renewable energy program, and the host will assist the host in preparing all applications and other documents necessary to receive these payments, including the designation of the supplier as a customer for CSI purposes or the allocation of ISC payments to the supplier. If the host receives payments under the ISC or other facility-related programs, with the exception of 9 (b), the host will make it to the provider without delay.
